TradingKeep Terms of Service

The rules for using TradingKeep, a free item-for-item trading site where every trade happens in-game between players and we're never a party to it.

1.A quick note before you start

This is a plain-English starting template, not legal advice. It has not been reviewed by a lawyer, and a few items below are marked as placeholders for the site owner to confirm. If you operate or rely on TradingKeep in any serious way, please have a qualified attorney review these Terms for your situation.

TradingKeep's whole reason for existing is to make game trading safer and simpler — "Game trading, kept safe." These Terms are written to match how the site actually works, not to bury you in fine print.

2.1. Agreement to these Terms

These Terms of Service (the "Terms") are a contract between you and TradingKeep ("TradingKeep," "we," "us," or "our"), the operator of tradingkeep.com (the "Site" or the "Service"). By creating an account, signing in, posting a listing, making an offer, sending a message, or otherwise using the Service, you agree to these Terms.

If you do not agree, please do not use the Service.

These Terms work alongside two other documents you should read: our Privacy Policy (which explains what data we collect and why) and our Community Guidelines (which explain the conduct rules in detail). Where the documents overlap, all three apply together.

3.2. Who can use TradingKeep (eligibility)

You must be at least 13 years old to use the Service. If you are under 13, you may not use TradingKeep, and we do not knowingly collect personal information from anyone under 13 (this is required by the U.S. Children's Online Privacy Protection Act, or COPPA).

You must also be old enough under the laws of where you live, and old enough under the rules of any game you trade items in. Some games set their own minimum ages or trading restrictions — following those is your responsibility.

By using the Service you confirm that you meet these requirements and that you are allowed to enter into this agreement.

4.3. What TradingKeep is — and what it is not

TradingKeep is a free, peer-to-peer barter marketplace for video-game items. Diablo II: Resurrected is the first supported game. You post listings offering an in-game item you have, and what other in-game items you'd accept for it. Other players make offers; you accept the one you like.

TradingKeep is fundamentally a discovery and record-keeping tool. We help two players find each other and we record when a trade has been mutually confirmed by both sides (a "dual-confirmed" trade). That confirmation is what unlocks a trade-verified review.

Crucially, we are NOT a party to any trade. TradingKeep never holds, escrows, transfers, or takes custody of any items, currency, payment, or game account. We are not a middleman or an escrow service, and we never will be — most games ban third-party middlemen anyway. Anyone on or off the Site who offers to "hold" items for you, including anyone claiming to be TradingKeep staff, is attempting to scam you.

5.4. Trades happen in-game, at your own risk

Every actual exchange of items happens entirely inside the game, directly between you and the other player. TradingKeep has no visibility into or control over whether either side honors a trade, and we cannot reverse, refund, or recover anything.

Because of this, you trade at your own risk. We give you tools to judge a trader — trade-verified reviews, earned trust tiers, and public scam-flag badges — but these are signals, not guarantees. A clean reputation does not make a trade safe.

Follow the core safety rules every time: never share your game account password or login with anyone; never "pay first" or hand over your items before the other side's items are in the trade window; confirm a trade only after the items are actually in your inventory; and treat anyone asking you to "trust trade" as a scammer. Our safe-trading guide and Community Guidelines explain this in more detail.

TradingKeep is not responsible for trades that go wrong, items lost, accounts compromised, or any other harm arising from a trade between users.

6.5. Your account and your responsibilities

You sign in to TradingKeep using Google or Discord (OAuth). We do not create or store a TradingKeep password for you — your sign-in is handled by your chosen provider. Keep that provider account secure, including its own password and two-factor settings; if someone gets into your Google or Discord account, they can get into your TradingKeep account.

Your TradingKeep account includes a public handle and an optional profile (such as a bio, title, avatar, and platform tags), along with your listings, offers, in-thread messages, trade-verified reviews, and trade history.

You are responsible for everything that happens under your account. Provide accurate information, don't impersonate other people or pretend to be TradingKeep staff, and don't create accounts to evade a ban or to manipulate reviews, trust tiers, or reports. One person should not run a network of accounts to game the trust system.

7.6. Acceptable use — and the hard ban on real-money trading

You agree to use TradingKeep only for legitimate item-for-item barter and to follow our Community Guidelines, which are part of these Terms. A few rules are important enough to state here directly.

Real-money trading is strictly prohibited. The "price" of a listing is always other in-game items — never cash, gift cards, cryptocurrency, or any real-world value. Buying or selling in-game items, currency, or accounts for real money is banned on TradingKeep, breaks most games' rules, and can get your game account banned. It is grounds for immediate removal from the Service.

Messaging is limited to offer threads, and chat links are rendered as plain text on purpose so phishing links can't land. Do not post external contact info or links to lure other users off-platform — this is a common scam pattern and is blocked or removed.

You also agree not to: harass, threaten, or abuse other users; post illegal, hateful, or sexually explicit content; attempt to defraud or "trust trade" anyone; use bots, scrapers, or automated tools to abuse the Service; attempt to break, overload, or bypass the Site's security or rate limits; or use TradingKeep for anything unlawful.

  • Item-for-item barter only — no real money, gift cards, or crypto, ever.
  • No middleman or "hold my items" arrangements.
  • No off-platform contact lures or phishing links in chat.
  • No harassment, fraud, impersonation, or staff impersonation.
  • No bots, scraping, or attacks on the Site's security or rate limits.

8.7. Your content and the permission you give us

"Your content" means anything you submit to the Service — your listings, offers, profile fields, in-thread messages, and reviews. You keep ownership of your content.

To run the Service, we need your permission to use it. You grant TradingKeep a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content for the purpose of operating and promoting the Service — for example, showing your listing in search results and on item pages, showing your trade-verified reviews on a trader's profile, and showing your handle and profile to other users. This license lasts as long as your content is on the Service (reviews and trade records may remain visible after a listing ends, since they reflect a completed trade).

You are responsible for your content and confirm you have the right to post it. Don't post content that infringes someone else's rights, and don't post anything false or misleading about an item or a trade.

Reviews are tied to verified trades — a review unlocks only after a dual-confirmed trade between the two parties — so please keep reviews honest and about the actual trade. We may remove content that violates these Terms or the Community Guidelines.

9.8. Trust, reputation, reports, and moderation

TradingKeep's trust signals are earned from real activity, not bought. Trust tiers are computed from your dual-confirmed trade history, your trade-verified reviews, and any confirmed scam flags. They cannot be purchased or asserted.

If something goes wrong, you can file a scam or harassment report against a trader from their profile or the offer thread. Reports are reviewed by our moderators. When a scam report is confirmed, a scam-flag badge appears publicly on that trader's profile and listings — visibly and on purpose.

Moderators may take action to keep the community safe, including warning a user, hiding or removing content, applying a scam flag, suspending an account, or permanently banning an account. We aim to be fair, but we may act quickly where there's a clear risk to users.

10.9. Listings, offers, and the trade flow

Listings stay live for 30 days and can be bumped every 6 hours to stay near the top; you can cancel a listing at any time. A trade is only counted once both sides press "confirm" (the dual-confirm step), which is also what unlocks a trade-verified review.

We may, but are not obligated to, remove or hide listings, offers, or messages that violate these Terms, appear to be scams, or are stale or expired. We don't set prices, recommend trade values as guarantees, or guarantee that any listing will result in a completed trade.

11.10. Supporter, Warden, and payments

TradingKeep is free to use. We also offer two optional paid memberships — Supporter and Warden — that help fund the Site and unlock cosmetic, convenience, and insight perks. Examples include an ad-free experience, profile cosmetics (a custom handle color, an avatar frame, and a membership badge), a Discord role, a listing highlight that helps your listings stand out, saved-search alerts, and longer listing life with auto-bump. The current tiers, pricing, and full perk lists are shown on the Supporter page and may change over time.

These memberships are never pay-to-win. They never let you buy in-game items, never change your trust tier, reputation, or reviews, and never affect whether a trade completes — every trade still happens in-game between the two players. Trading on TradingKeep stays about skill and reputation, and we won't put core trading or safety features behind a paywall.

Payments are processed by Stripe, our third-party payment processor. We do not see or store your card numbers; Stripe handles that. We store only a customer reference and your tier and its expiry. Your use of Stripe is also subject to Stripe's own terms.

Refunds: paid tiers are billed for the period you select and you can cancel at any time to stop future charges; cancellation takes effect at the end of your current paid period. Except where required by law, fees already paid are non-refundable. This refund stance is a placeholder for the owner to confirm and adjust before launch.

12.11. Intellectual property and the fan-made disclaimer

The TradingKeep name, logo, Site design, and original text are owned by TradingKeep and protected by intellectual-property laws. Please don't copy or reuse them except as allowed by these Terms or by law.

TradingKeep is a fan-made site. It is NOT affiliated with, endorsed by, sponsored by, or otherwise connected to Blizzard Entertainment or any game publisher. Diablo II: Resurrected and all other game names, item names, images, and trademarks belong to their respective owners, and are referenced here only to let players identify the items they trade.

13.12. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent allowed by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or always available.

Because TradingKeep is only a discovery and record-keeping tool and is not a party to any trade, we make no warranty about other users, about any trade, or about whether anyone will honor a trade. Trust tiers, reviews, and scam flags are informational signals only and are not a guarantee of any trader's honesty or of any outcome.

We do not warrant the accuracy of item data, values, or any other information shown on the Site.

14.13. Limitation of liability

To the fullest extent permitted by law, TradingKeep and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of items, game accounts, data, profits, or goodwill, arising out of or related to your use of the Service.

In particular — and because trades happen entirely in-game between users, off our platform — TradingKeep is not liable for trades that go wrong, items not delivered, scams, account theft, bans imposed by a game, or any dispute between users. Your remedy for a bad trade is with the other user and, where applicable, with the game's own support, not with TradingKeep.

Because the Service is free to use aside from the optional Supporter membership, to the maximum extent permitted by law our total liability to you for any claim relating to the Service will not exceed the greater of the amount you paid us (if any, such as a Supporter or Warden membership fee) in the 12 months before the claim, or fifty U.S. dollars (USD 50).

Some places don't allow certain warranty disclaimers or liability limits, so parts of sections 12 and 13 may not apply to you; in that case those limits apply only as far as the law allows.

15.14. Termination and bans

You can stop using TradingKeep at any time, and you can ask us to delete your account (see the Privacy Policy for how account and data deletion works).

We may suspend or terminate your account or access, with or without notice, if you break these Terms or the Community Guidelines, attempt fraud or a scam, harm other users, or create risk for the Service. Confirmed scammers and ban evaders will be removed.

Some information may remain after termination where it reflects real activity or is needed for safety — for example, trade-verified reviews and trade records tied to a completed trade, and confirmed scam flags. Sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and governing law) continue to apply after your account ends.

16.15. Copyright and IP takedown (DMCA)

If you believe content on TradingKeep infringes your copyright or other intellectual-property rights, send a notice to support@tradingkeep.com. Please include: a description of the work or right you say is infringed; the specific URL or location of the content on the Site; your contact information; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them.

We will review valid notices and may remove or disable the content. If you are a user whose content was removed and you believe that was a mistake, you may contact us at the same address to dispute it.

17.16. Changes to these Terms

We may update these Terms from time to time — for example, as the Service adds games or features. When we do, we'll update the effective date at the top, and for significant changes we'll make a reasonable effort to let users know.

Your continued use of the Service after an update means you accept the revised Terms. If you don't agree to a change, please stop using the Service.

18.17. Governing law

These Terms are governed by applicable United States law, without regard to conflict-of-laws rules. Any disputes will be handled in the courts having jurisdiction where the operator is based. [Placeholder — the site owner should confirm the dispute-resolution approach before launch.]

Nothing here takes away any rights you have under the mandatory consumer-protection laws of the place where you live.
